Recent changes in the renewable energy market, i.a. entering into force the Polish Wind Energy Investment Act, have substantially changed the possibility of the implementation of the wind farm projects in Poland. Investments that didn’t make it to the building permit phase before entering into force the aforementioned act and that don’t comply with the provisions stated therein (i.a. the distance criteria) are at a very high risk of obtaining a negative decision. Therefore the investors that bore substantial costs connected with the development of the wind farm projects, may not have the possibility to implement the investment. There are a few ways of protecting investors’ rights under the Polish and international law (compensation for damages and/or losses).
